Disfigurement Legal Definition

There are several categories of damages that you have the legal right to receive in Texas. These are designed to compensate you not only for the costs you have incurred as a result of expenses and costs of an injury such as medical bills and loss of income, but also to compensate you for the actual injury you have suffered. These types of damage are called “general damage” because there is no price for this type of injury. A disfiguring wound wreaks havoc that only overwhelms dollars and cents. However, the person responsible for your injury is required by law to cover your current and future costs, not only your expenses, but also your pain and suffering, reducing your lifetime earning potential, and much more. Statistically, you are likely to receive higher compensation if your disfigurement is clearly visible, such as facial scars, or if the injury has permanently inhibited your mobility. Moore was charged under K.S.A. 21-3414(a)(1)(A), which defines a heavy battery as intentionally causing serious bodily harm to another person or disfiguring another person. “Simple battery is a less contained heavy battery offence and is defined as intentionally or recklessly causing bodily harm to another person.” K.S.A.2000 Supp. 21-3412. The crucial difference between the two offences lies in the damage caused.

Id. Aggravated violence involves “significant physical harm” or “disfigurement,” while simple battery only involves “bodily harm.” The Court of First Instance found that the victim`s injuries constituted disfigurement. However, when the trial court informed jurors of the heavy battery, it pointed to both “serious bodily harm” and “disfigurement.” In other words, the jury could have concluded that the accused intentionally inflicted serious bodily harm or disfigurement when convicted of grievous bodily harm. Thus, the Kansas Supreme Court considered both “disfigurement” and “major bodily harm” to resolve the issue presented. Id. The elements of harm that the jury should consider were: his past physical pain; the physical pain that he is reasonably likely to suffer in the future; past and future psychological torments, including disfigurement, humiliation, embarrassment and concern for their well-being; and its loss of earning capacity, which it is reasonably likely to maintain in the future. Disfigurement is the condition in which the appearance is deeply and constantly medically damaged, for example, by a disease, birth defect or wound. Society`s general attitude towards disfigurement varies considerably from culture to culture and over time, with cultures that have a strong social stigma against it often causing psychological distress to disfigured individuals. Alternatively, many societies have considered some form of disfigurement in a medical and scientific context where someone who has ill will against disfigured people is considered anathema. In various religious and spiritual contexts, disfigurement has been variously described as a punishment of the divine for sin (such as Yahweh`s disfigurement of Cain for the murder of Abel in Judaism), as (like Paul`s New Testament arguments about Christ`s sufferings) caused by supernatural forces of hatred and evil against good and righteousness. who is atoned for later, or as if without explanation in itself with people who only have to endure.
